A court marriage gives a couple a legally valid marriage and an official certificate. In Punjab, the procedure depends mainly on the religion of both partners. This guide explains the process step by step.
1. Find out which Act applies
- Special Marriage Act, 1954 applies to any two people, including inter-religion couples and marriages with foreign nationals.
- Hindu Marriage Act, 1955 applies when both partners are Hindu, Sikh, Jain or Buddhist. The marriage is performed by ceremony and then registered.
- Anand Marriage Act, 1909 lets Sikh couples married by Anand Karaj register their marriage.
In addition, the Punjab Compulsory Registration of Marriages Act, 2012 requires marriages in Punjab to be registered.
2. Check eligibility
The groom must be at least 21 and the bride at least 18. Neither partner may have a living spouse, and both must be capable of giving valid consent.
3. Prepare the documents
Both partners need age proof, address proof, photographs and affidavits about date of birth, marital status and nationality. Witnesses must bring ID proof. If either partner was married before, a divorce decree or death certificate is needed.
4. File the application or notice
Under the Special Marriage Act, a notice is given to the Marriage Officer of the district where at least one partner has lived for 30 days. The notice is displayed publicly, and anyone may raise a legal objection within 30 days. Under the Hindu or Anand Marriage Act, the couple applies to the Registrar after the marriage ceremony.
5. Marriage and registration
Both partners appear with witnesses before the Marriage Officer or Registrar, sign the register, and the marriage certificate is issued.
How long does it take?
Under the Special Marriage Act, at least 30 days because of the notice period. Under the Hindu or Anand Marriage Act, registration after the ceremony is usually much faster.
What does it cost?
Government fees are nominal. The total depends on documentation, affidavits and urgency. A good advocate will tell you the complete amount at the first meeting.
